Becalm Trading (Pty) Ltd t/a (“Terrace Living”) warrants to the original purchaser and to any person to whom the product is given or sold during warranty with the original proof of purchase, that all product supplied by Terrace Living and or under the brand name ‘CALM’ are manufactured from new materials or in the case of hardwoods, original raw timber treated in approved factories. Furthermore Terrace Living warrants that the range of outdoor products it sells is free from abnormal defects in material and workmanship and is in good working order. The company does not warrant uninterrupted or error free use of its products.

The General Warranty from date of purchase, for WORKMANSHIP is for a period of THREE YEARS and for MATERIALS is for a period of TWO YEARS. Provided that such material is subjected to normal use in an indoor or outdoor environment and that maintenance as recommended by Terrace Living is followed. However SPECIAL PROVISION is made for products that are stored and or used in coastal areas, within five kilometres of the sea, where the extreme salt, sand and wind conditions have an abnormal effect on all materials. In such conditions Terrace Living will only provide a ONE YEAR warranty on all materials.

During the Warranty period, Terrace Living will first attempt to diagnose or rectify faults or problems over the telephone, the internet or by fax. Terrace Living and/or its appointed employees and/or agents shall at their sole discretion decide whether the furniture is defective and whether warranty is valid. It shall be at the discretion of Terrace Living to remedy any defect by adjusting, repairing or replacing the relevant product(s).

Warranty does not include repair or replacement caused by: modifications or attachments made to the product, ‘acts of God’, accidental damage or misuse.

The Purchaser’s sole remedy is the Warranty set forth above. Terrace Living’s liability for the actual damages of any kind will be limited to the price paid for the product, its repair or replacement. This limitation of liability for actual damages does not apply to bodily injury or property damage for which Terrace Living is held legally liable. In no event will Terrace Living be liable for lost profits, incidental or consequential damages, even if advised of the said damages.

The statement of limited warranty is the exclusive warranty. All other express or implied warranties including the implied warranties of merchantability and fitness for a particular purpose are excluded (except where said implied warranties are required by applicable law). No warranties either expressed or implied will apply after the expiration of the warranty period. The warranty is extended only in the event of the product having been purchased from Terrace Living and Terrace Living may, at its discretion, request proof of the purchase.
